Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Forthera Financial, including Forthera Financial & Insurance Group, LLC and its affiliated companies (collectively, "Forthera," "we," "us," or "our"). These Terms govern your access to and use of our website at fortherafinancial.com and our financial coaching, consultation, and insurance services. By accessing our website, creating an account, booking a consultation, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.
2. Eligibility You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and will use our services in compliance with these Terms and all applicable laws.

3.1 Financial Coaching Services Forthera Financial provides financial coaching and consultation services designed to help you understand and manage your finances, set and achieve financial goals ,develop budgeting and savings strategies, and make informed financial decisions. Our financial coaching services are educational in nature and do not constitute financial advice, investment advice, or fiduciary services.
3.2 Insurance Services All insurance offers, solicitations, and recommendations made via our website are provided by Forthera's licensed affiliated insurance producers. No insurance offers, solicitations, or recommendations are made in any state where Forthera's licensed producers do not hold appropriate licenses. Insurance products are subject to underwriting requirements and may not be available in all states.

Booking and Appointments When you book a consultation or appointment through our website, you agree to attend at the scheduled time or provide at least 24 hours' notice for cancellations ,provide accurate information necessary for your consultation, and pay any applicable fees according to our payment terms. We reserve the right to reschedule or cancel appointments with reasonable notice.
7. Fees and Payment Fees for our services are disclosed at the time of booking or engagement. Payment is due according to the terms specified for each service. We accept payment through methods specified on our website. All fees are non-refundable unless otherwise stated or required by law. We reserve the right to change our fees at any time with notice to existing clients.
8. Intellectual Property All content on our website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Forthera Financial or its content suppliers and is protected by United States and international copyright laws. 12. Dispute Resolution

12.2 Arbitration Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Sacramento County, California. Judgment on the arbitration award may be entered in any court having jurisdiction.
12.3 Class Action Waiver You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
13. Termination We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
